PAYMENT AND ORDERING ONLINE
Once a Customer has placed an order and their credit card or paypal debit has been authorrzed, this is considered a sale and all adjustments made to this order and to payments, including the use of coupon codes not used at the time of sale, are at the sole discretion of MEGAComfort. MEGAComfort also reserves the right not to accept an order from any customer or once an order has been made to cancel the order and provide a full refund.
MEGAComfort will attempt to ship all orders within 2-3 business days. Unfortunately, due to overwhelming demand and other factors, this is not always possible. In such cases, MEGAComfort will attempt to ship these orders as soon as possible and in a timely fashion. As a result, no discounts or refunds will be given for fullfillment delays.
MEGAComfort will ship using the carrier of its choice and assumes no responsibility for carrier time and in transit delays. All merchandise is packed carefully for shipment, therefore MEGAComfort is not responsible for damaged product suffered in transit once the carrier has accepted it. Should the Customer discover damages or loss in shipment, the Customer shall be responsible for contacting the carrier immediately and filing a claim. MEGAComfort will gladly assist the Customer in every possible way in settling claims for damages or loss, but we are not responsible for the collection of claims or replacement of merchandise.
ERRORS AND SHORTAGES
All claims for shortages or errors in shipments must be made within 5 (five) business days of receipt of shipment.
WARRANTY AND PRODUCT RETURNS
MEGAComfort warrants that products sold shall be free from defects in material and workmanship.
Due to Health Concerns, products that have been worn cannot be returned.
As well, no returns of unworn products will be allowed unless authorized in writing, in advance, by MEGAComfort, at its sole discretion. All such pre-authorized returns will still be subject to a 15% restocking fee, except in cases where MEGAComfort is replacing defective goods or correcting an order already sent out. MEGAComfort may also at its own discretion replace unworn insoles, with written pre-authoriztion, when an incorrect size was ordered. In such cases the customer will pay shipping charges in both directions.
For US Orders, Sales Taxes are applicable to all goods sold to Customers whose shipping address is in the State of California. California Sales Tax at a rate of 7.75 % shall be added to the purchase price and paid by the Customer unless the Customer completes MEGAComfor’s tax exemption certificate (available upon request) acceptable to the appropriate taxing authorities. The signed certificate has to be sent to MEGAComfort in ADVANCE of the order being processed on line, as sales tax is automatically charged for California shipping addresses and cannot be rebated. GST and/or its Provincial equivalent is appplicable to all Canadian Orders.
MEGAComfort shall not be liable for any loss or damage resulting from inability to deliver goods due to natural disaster, fire, labor disputes, accidents, acts of civil or military authority or from any other cause beyond MEGAComfort’s control.
Customer accounts with MEGAComfort, and all transactions and any disputes between the Customer and MEGAComfort for US Customers, shall be governed by and/or construed under and in accordance with the laws of the State of California and for Canadian Customers with the laws of the Province of Quebec.
